Regarding HRCSL’s Landmark recommendations on the Attire of Muslim Healthcare Personnel…
Healthcare workers must never have to decide between their personal dignity, their faith, and their obligation to serve patients.
Recently the Human Rights Commission of Sri Lanka (HRCSL) reached an important decision regarding the clothing of Muslim female healthcare workers. This decision came about because of an incident in which newly appointed assistants at Kalmunai North Base Hospital were forced to take off their headscarves, long sleeves and trousers, or face a disciplinary transfer, and since then the problem has been reflected in other areas such as Kalutara.
The HRCSL’s findings cut straight to the core of constitutional rights and common sense:
• Modesty is a right which is protected rather than seen as a violation: the Commission stated that wearing a headscarf and modest clothing together with the required uniforms is fully in line with the constitutionally guaranteed freedom of religion (Articles 10 and 14(1)(e)).
• Circulars cannot override basic rights: although administrative rules such as circulars do not possess the status of “law” and thus cannot arbitrarily limit fundamental rights, it is interesting that the existing circulars themselves do not prohibit the wearing of head coverings, since different local interpretations have resulted in arbitrary restrictions in Kalmunai, while in neighbouring hospitals like those in Ampara staff have been treated without any problems.
• Dignity in the workplace is important: to pick out female employees and impose sudden disciplinary transfers without following due process amounts to discrimination and weakens the safe and inclusive public sector that our country needs.
The Commission has made clear and practical recommendations: the Kalmunai North Base Hospital should reappoint the affected healthcare assistants and clarify the dress code, while the Ministry of Public Administration should publish an updated circular, based on Circular 13/2019, confirming the right of public officers to wear religious attire whilst still keeping their identity clearly visible.
Every single day healthcare workers work to save lives and to heal our communities. The authorities should quickly put into effect the HRCSL’s guidelines across the country in order that respect, fairness, and inclusion may be introduced in all government hospitals.
